Are you submiting the job as 32 or 64 bit? Does the 64bit server have both versions of Max installed?

The machine with the x64 OS can have both versions of Max installed. Then it can render both types of job, depending on what type is submitted, using the Advanced settings in the Net Render Job Submission dialog.
Do you have the latest Service Pack/Hotfix for Max 2009 installed? The original install, before any SP’s of Max 2009 would often throw up these errors in Backburner.
