Partly this is a windows problem - file associations. You can only associate a file extension (in this case .max) with one application.
Normally, this will be the last version installed (of Max) but not always. I have many versions installed, but if I dbl-clk a .max then I get Max 8, despite them all being installed in sequence.(you would expect to get Max 2010, but no...)
Partly this is a workflow issue. Personally I never double-click Max files, I always load the version I need then File>Open, I also never put “documents” on the desktop, only programs, mainly to keep all the data for a program with the program - that’s for all programs, not just Max
The real problem with using the file associations to load a .max scene (from an earlier version) is that if it opens the latest version and you then save the file it can no longer be opened in the original version, very dangerous.
It may be possible to fix the association problem, but tbh I wouln’t even bother.
