addNewXRefObject merge:modifers not working properly when reopening the file.

i am using xref objects in a few scripts and is a bug on them or at lest i dont know how to solve it.

when you use addNewXRefObject modifiers:#merge

he will do what si suposse to do so only the base obejct will base and xref object and the modifiers will be merge in scene.
but the problem happen when you restart the xref base oebjct will be setup as as xref modifiers so you wil have the modifers two times.one in scen and one in base object.

the xref object will be in the xref object tool listed as a xref in modifiers, not asa a merge so the modifiers will be two times.

the easiest way of checking this is putting a turbosmooth on the modifier.
if you do by hand using the tool , yo will see that we you select thew object the modifiers is in merge so wjen yopu reopnm the scen al stay the same.

but when you use max script the modifier is set to xref and cant be change. so we will got the modifers merge in scene and included in the xref object when we restart the scene.

i am using max2008 , has anyone find a solution for this.???
